Actually, I think its to create a barrier to frequent name changes.  Basically people could sock themselves anytime they did or said something lame, by changing their gamertag.  By forcing you to put some skin in the game, it makes you less likely to change it for arbitrary or irresponsible reasons.  It would also make life more complicated for players with a lot of friends.

Is there a way to check for the desired gamertag's availibility before paying that money to change it? It would be a huge waste if I spent the money just to not get the gamertag I waned

First off, it's only 800 MS points. Which doesn't matter, because I got 2800 points + 12 months xbox live gold for free when I bought my xbox 360. So i don't care what i use the points on. (I have 1020 points left). I changed my Gamertag from Exospherical to SaggyOldPeople because people said Exospherical was stupid and had no meaning and wasnt funny. :{

dude - who cares about your gamertag - XBL has some great games on there; a much better use of the points, IMO.  Geometry Wars, Braid, Castle Crashers... and some classic re-releases and reboots as well.
